The Texas Supreme Court recently held the Kirby Co. liable for failing to investigate the background of an employee that raped a woman while conducting an in-home vacuum demonstration. The court of Texas felt that the Kirby Co. was negligent by not conducting a background check on independent contracts that they send into peoples' homes. The court up held $160,000 in damages.
